Description : Read Now Human Rights Law In Europe by Kanstantsin Dzehtsiarou and you can download with pub, pdf, txt, doc, and more file format with free account. this book provides analysis and critique of the dual protection of human rights in europe by assessing the developing legal relationship between the court of justice of the european union (cjeu) and the european court of human rights (ecthr). the book offers a comprehensive consideration of the institutional framework, adjudicatory approaches, and the protection of material rights within the law of the european union and the european convention on human rights (echr). it particularly explores the involvement and participation of stakeholders in the functioning of the eu and the ecthr, and asks how well the new legal model of ‘the eu under the ecthr’ compares to current eu law, the echr and general international law. including contributions from leading scholars in the field, each chapter sets out specific case-studies that illustrate the tensions and synergies emergent from the eu-echr relationship. in so doing, the book highlights the overlap and dialectic between europe’s two primary international courts. the book will be of great interest to students and researchers of european law and human rights.

Description : Read Now The Accession Of The European Union To The European Convention On Human Rights by Paul Gragl and you can download with pub, pdf, txt, doc, and more file format with free account. after more than 30 years of discussion, negotiations between the council of europe and the european union on the eu's accession to the european convention on human rights have resulted in a draft accession agreement. this will allow the eu to accede to the convention within the next couple of years. as a consequence, the union will become subject to the external judicial supervision of an international treaty regime. individuals will also be entitled to submit applications against the union, alleging that their fundamental rights have been violated by legal acts rooted in eu law, directly to the strasbourg court. as the first comprehensive monograph on this topic, this book examines the concerns for the eu's legal system in relation to accession and the question of whether and how accession and the system of human rights protection under the convention can be effectively reconciled with the autonomy of eu law. it also takes into account how this objective can be attained without jeopardising the current system of individual human rights protection under the convention. the main chapters deal with the legal status and rank of the convention and the accession agreement within union law after accession; the external review of eu law by strasbourg and the potential subordination of the luxembourg court; the future of individual applications and the so-called co-respondent mechanism; the legal arrangement of inter-party cases after accession and the presumable clash of jurisdictions between strasbourg and luxembourg; and the interplay between the convention's subsidiarity principle (the exhaustion of local remedies) and the prior involvement of the luxembourg court in eu-related cases. the analysis presented in this book comes at a crucial point in the history of european human rights law, offering a holistic and detailed enquiry into the eu's accession to the echr and how this move can be reconciled with the autonomy of eu law.

Description : Read Now The Eu S Human Rights Dialogue With China by Katrin Kinzelbach and you can download with pub, pdf, txt, doc, and more file format with free account. the european union uses a confidential, institutionalized dialogue to raise human rights concerns with china, but little is publicly known about its set-up, its substance, its development over time and its impact. this book provides the first detailed reconstruction and assessment of the eu’s responses to human rights violations in china from 1995 to the present day. using classified documents in the eu’s historical archives and interviews with diplomats, officials and human rights experts in europe, china and the united states, kinzelbach lifts the veil of secrecy on the eu-china human rights dialogue and provides a rare insight into how the european union and china conduct quiet diplomacy on human rights. the book reconstructs the evolution of the dialogue and the eu’s internal debate on the merits of quiet diplomacy, and draws comparisons with the approach of other actors, notably that of the united states. in doing so, the eu’s relative impact is concluded to be tenuous if not counter-productive. the book also chronicles and analyzes numerous human rights concerns that were raised in the period, ranging from structural issues to individual cases. this ground-breaking, in-depth case study will be of interest to students and scholars of international politics, human rights, international law, eu politics, especially the eu’s common foreign and security policy, and chinese politics.

Description : Read Now Human Rights In Europe by William B.T. Mock and you can download with pub, pdf, txt, doc, and more file format with free account. human rights in europe is designed to help human rights lawyers and activists, as well as students and scholars of comparative and constitutional law, understand the european union¿s charter of fundamental rights and freedoms. drafted more than 50 years after the onset of european integration, the charter is deeply influenced by the disparate legal practices of the member states, as well as by the 1948 universal declaration of human rights and the 1950 european convention for the protection of human rights and fundamental freedoms. unlike the u.s. bill of rights, the charter is a lengthy document, which seeks to provide european citizens with specific rights in areas as diverse as family law, labor law, administrative procedure, and the protection of personal data. building upon an award-winning volume of european scholarship, this book brings together a dozen major italian professors of constitutional law, political science, and economics, who have written chapters investigating each of the charter¿s 54 articles with reference to national and international jurisprudence and political philosophy. especially prepared for a u.s. audience, this volume is replete with references and sources that provide interested readers with access to some of the best european human rights scholarship available anywhere.

Description : Read Now Human Rights And Minority Rights In The European Union by Kirsten Shoraka and you can download with pub, pdf, txt, doc, and more file format with free account. the end of the cold war has ushered a restructuring of the institutions of the european community, culminating into its enlargement to eastern europe, under the aegis of economic integration, democracy and human rights. this book examines the development and the role of human rights in the european union, from its inception as an economic co-operation project to an organisation of european states with a political agenda that goes beyond its borders. it argues that human rights have become an important component of the foreign policy of the european union and that this role has grown from the inception of the union through the cold war and thereafter onto the process of enlargement of the union. the book goes on to analyse the eu’s policy on minorities, as a particular example of human rights. it considers the level of their protection within the eu and the framework of international law, and compares minority rights in the older member states including france, germany and the uk, with newer eastern european states.

Description : Read Now Human Rights In Business by Juan José Álvarez Rubio and you can download with pub, pdf, txt, doc, and more file format with free account. the capacity to abuse, or in general affect the enjoyment of human, labour and environmental rights has risen with the increased social and economic power that multinational companies wield in the global economy. at the same time, it appears that it is difficult to regulate the activities of multinational companies in such a way that they conform to international human, labour and environmental rights standards. this has partially to do with the organization of companies into groups of separate legal persons, incorporated in different states, as well as with the complexity of the corporate supply chain. absent a business and human rights treaty, a more coherent legal and policy approach is required. faced with the challenge of how to effectively access the right to remedy in the european union for human rights abuses committed by eu companies in non-eu states, a diverse research consortium of academic and legal institutions was formed. the consortium, coordinated by the globernance institute for democratic governance, became the recipient of a 2013 civil justice action grant from the european commission directorate general for justice. a mandate was thus issued for research, training and dissemination so as to bring visibility to the challenge posed and moreover, to provide some solutions for the removal of barriers to judicial and non-judicial remedy for victims of business-related human rights abuses in non-eu states. the project commenced in september 2014 and over the course of two years the consortium conducted research along four specific lines in parallel with various training sessions across eu member states. the research conducted focused primarily on judicial remedies, both jurisdictional barriers and applicable law barriers; non-judicial remedies, both to company-based grievance. the results of this research endeavour make up the content of this report whose aim is to provide a scholarly foundation for policy proposals by identifying specific challenges relevant to access to justice in the european union and to provide recommendations on how to remove legal and practical barriers so as to provide access to remedy for victims of business-related human rights abuses in non-eu states.
