Description : Read Now The Patent Crisis And How The Courts Can Solve It Large Print 16pt by Dan L. Burk and you can download with pub, pdf, txt, doc, and more file format with free account. patent law is crucial to encourage technological innovation. but as the patent system currently stands, diverse industries from pharmaceuticals to software to semiconductors are all governed by the same rules even though they innovate very differently. the result is a crisis in the patent system, where patents calibrated to the needs of prescription drugs wreak havoc on information technologies and vice versa. according to dan l. burk and mark a. lemley in the patent crisis and how the courts can solve it, courts should use the tools the patent system already gives them to treat patents in different industries differently. industry tailoring is the only way to provide an appropriate level of incentive for each industry. burk and lemley illustrate the barriers to innovation created by the catch-all standards in the current system. legal tools already present in the patent statute, they contend, offer a solution - courts can tailor patent law, through interpretations and applications, to suit the needs of various types of businesses. the patent crisis and how the courts can solve it will be essential reading for those seeking to understand the nexus of economics, business, and law in the twenty-first century.

Description : Read Now The Lion That Didn T Roar by Nigel Davidson and you can download with pub, pdf, txt, doc, and more file format with free account. in 2017 it will be australia’s turn to chair the kimberley process certification scheme (kp), an international organisation set up to regulate the trade in diamonds. diamonds are a symbol of love, purchased to celebrate marriage, and it is therefore deeply ironic that the diamond trade has become linked with warfare and human rights violations committed in african producer countries such as sierra leone, the democratic republic of congo and, more recently, zimbabwe and angola. in their quest for diamonds, or by using diamonds to purchase weapons, armed groups in these countries have engaged in recruiting child soldiers, amputating limbs, and committing rape and murder. in response to the problem, the international community, non-governmental organisations and key industry players such as de beers combined forces to create the kimberley process in 2002. the kp uses an export certificate system to distinguish the legitimate rough diamond trade from so-called ‘blood diamonds’, which are also known as ‘conflict diamonds’. this book considers the extent to which the kp, supported by other agencies at the international and national levels, has been effective in achieving its mandate. in so doing, it presents an original model derived from the domain of regulatory theory, the dual networked pyramid, as a means of describing the operation of the system and suggesting possible improvements that might be made to it.

Description : Read Now Orientalism Aramaic And Kabbalah In The Catholic Reformation by Robert J. Wilkinson and you can download with pub, pdf, txt, doc, and more file format with free account. focusing upon the extraordinary circumstances of the production of the editio princeps of the syriac new testament in 1555 and establishing a reliable history of that edition, this book offers a new account of the origin of syriac studies in europe and a fresh evaluation of catholic orientalism in the sixteenth century. the reception of syriac into the west is shown to have been characterised, under the influence of egidio da viterbo and postel, by a christian kabbalistic world-view which also determined the reception of other oriental languages. the companion volume the kabbalistic scholars of the antwerp polyglot bible exhibits the continuing influence of christian kabbalism on later editions.

Description : Read Now Patent Failure by James Bessen and you can download with pub, pdf, txt, doc, and more file format with free account. in recent years, business leaders, policymakers, and inventors have complained to the media and to congress that today's patent system stifles innovation instead of fostering it. but like the infamous patent on the peanut butter and jelly sandwich, much of the cited evidence about the patent system is pure anecdote--making realistic policy formation difficult. is the patent system fundamentally broken, or can it be fixed with a few modest reforms? moving beyond rhetoric, patent failure provides the first authoritative and comprehensive look at the economic performance of patents in forty years. james bessen and michael meurer ask whether patents work well as property rights, and, if not, what institutional and legal reforms are necessary to make the patent system more effective. patent failure presents a wide range of empirical evidence from history, law, and economics. the book's findings are stark and conclusive. while patents do provide incentives to invest in research, development, and commercialization, for most businesses today, patents fail to provide predictable property rights. instead, they produce costly disputes and excessive litigation that outweigh positive incentives. only in some sectors, such as the pharmaceutical industry, do patents act as advertised, with their benefits outweighing the related costs. by showing how the patent system has fallen short in providing predictable legal boundaries, patent failure serves as a call for change in institutions and laws. there are no simple solutions, but bessen and meurer's reform proposals need to be heard. the health and competitiveness of the nation's economy depend on it.

Description : Read Now The Principle Of Equality Of Arms In International Criminal Proceedings by Mascha Fedorova and you can download with pub, pdf, txt, doc, and more file format with free account. this book examines the interpretation and application of the principle of equality of arms in proceedings before several international criminal courts. the coming of age of these institutions merits an evaluation of the application of one of the fundamental principles underlying a criminal procedure. the practice of these courts presents some substantial challenges to achieving a meaningful equality of arms in the context in which these courts operate. before studying the law and jurisprudence of the international criminal tribunals - for the former yugoslavia and rwanda, the special court for sierra leone, the international criminal court, and the extraordinary chambers in the courts of cambodia - the historical roots and the meaning of the principle of equality of arms are examined from two perspectives: the human rights perspective and the criminal process perspective. subsequently, four themes that are central to understanding the principle of equality of arms in the international criminal context are discussed. first, the focus is on the investigation stage of the criminal process and the ability of the parties to prepare for trial. next, the study takes a closer look at the system of disclosure of materials that were collected during investigations. third, attention is paid to the issue of the perceived inequality in resources and facilities between the parties and the institutionally unequal positioning of the defense. last, issues concerning the presentation of the case at the trial stage - such as the time and the number of witnesses the parties are allowed to present and the issues relating to the examination of witnesses and the admissibility of evidence - are examined. the book concludes with general observations on the scope and proper understanding of the principle of fairness, the right to a fair trial, and the principle of equality of arms.
